Trademark Registration in Dubai

Under Dubai law, a trademark is a mark that can be affected by geography in a way that makes it possible to tell the difference between goods (trademarks) or services (service marks) made by one business and those made by other businesses.

A trademark can be a word (even a person’s name), a letter, a color, a group of colors, a drawing, a number, the shape of the goods, how they are packaged, a 3D picture, a smell or taste, or a picture with depth.

The Process of Dubai Trademark Registration

Investing in Dubai is one of the best choices a business owner can make for a number of reasons. The country is always getting better, so it can give its investors more. When you register your business in Dubai, you can also register a trademark.

For a trademark to be registered, an application must be sent to the department of intellectual property at the Ministry of Commerce and Industry (MOCI). The Executive Regulations for the IP Law spell out the terms and conditions for this.

The trademark application must include a description of the mark and a list of goods and services for which the mark needs to be registered, as long as they are in the preferred category or categories in the international classification.

The department will then look at the registration application to see if the trademark can be registered. As the department looks over the application, it will send written objections to certain parts of the trademark, such as the range of goods or services, or tell the applicant to change the logo.

The applicant can respond to the department’s concerns, and once the differences are worked out, the department will accept the trademark application for registration. Both the official gazette and a local newspaper print the same thing.

Publications in the Official Gazette and local newspapers are meant to invite anyone who is interested to object to the registration of a trademark that goes against their interests.

If there are any objections, the department will then send a copy of the applicant’s response to the people who made the objections. After hearing from both sides, the department will decide whether or not to accept the application based on the complaints.

Dubai Trademark Registration Requirements

  • A power of attorney that has been stamped with an apostille.
  • A copy of the business registration papers for the applicant.
  • A copy of the trademark that is being considered for registration in Dubai in its original color.
  • A certified copy of the documents of priority (in case priority is to be claimed).
  • Information about the goods, services, and products for which the trademark will be registered.

Dubai Trademark Renewal Requirements

A power of attorney, which is a general power, can be used to renew itself after 6 months.

Time Frames

The average amount of time it takes from when a trademark application is filed to when it is registered, if no office actions or oppositions are filed or sent, is as follows:

  • Filing up to Examination: 4 to 6 months
  • Examination up to publication: 4 to 6 months
  • Opposition period: 3 months
  • End of Opposition Period up to Issuance of Registration Certificate: 2 months
  • Total Estimated Time Frame: 12 to 16 months

Time Frames for Renewal

Here are the dates for renewal up until the certificate of renewal is given.

  • From filing to exam, it takes one month.
  • Check out what's in the book (if it exists)- 3 months
  • From the date of publication to when the renewal certificate is given: 6 to 8 months
  • All told, it should take between 6 and 8 months.
